General Information

These terms of service govern the use of the "YourShelf" app (hereinafter referred to as "the app") and the associated website. By using the app and/or the website, you agree to the terms of service without restriction. Therefore, it is advised to carefully read the terms of service before using the app.

Purpose of the App

The app was developed to provide users with the opportunity to exchange information about books, write reviews and related comments, find new books based on personal preferences, and manage a virtual book collection. With the app, you can mark your read books, write reviews, comment on them, follow other users, manage books in a todo list, and upload book covers that help other users easily identify books.

Scope of Application

These terms of service apply to both the app and the website. By using the app, you agree to these terms and declare your commitment to comply with them.

Special Provisions

As the operator of the app, we reserve the right to establish certain provisions and restrictions to ensure safe and appropriate use of the app. These include, among others:

• Removing reviews, comments, and images from users without prior notice if they violate these terms of service or applicable laws
• In case of serious violations, blocking users or terminating their access to the app

We assume no responsibility for the content of reviews and ratings created by users. These reflect the opinions of the respective users. The handling of personal data is outlined in the privacy policy.

Registration and Account

To fully use the app's features, you must register. This requires providing an email address, password, and username. By registering, you agree to the terms of service of this app and confirm that you are at least 14 years old. Please note that no age verification is performed.

Multiple registrations are possible. However, it is prohibited to create new user accounts or reviews in an automated manner.

Personal data stored during app usage is encrypted using state-of-the-art security technologies and stored in Microsoft's infrastructure. Please refer to our privacy policy for more information.

The security of your account is the responsibility of users. We therefore recommend choosing a secure password and keeping it confidential. We do not store passwords. Our system uses a ticket-challenge system to ensure the security of your account.

Usage Rights and Restrictions

It is strictly prohibited to distribute illegal content, harassment, bullying, or other forms of abusive behavior. It is forbidden to upload or share content such as hate speech, discrimination, nudity and sexual content, violence and threats, copyright infringement, spam and fraudulent content, as well as encrypted text in the app. Advertising and commercial content must be clearly marked as such to ensure that reviews cannot be purchased. Please contact the app manufacturer beforehand to agree on appropriate labeling. Furthermore, it is prohibited to disclose personal data in comments or reviews.

Please note that all content created in the app is transferred to UHS Computer. This allows the company to retain rights to the content, even if your account is deleted or you no longer use the app. This enables us to continue to have control over the content and take measures if necessary to ensure compliance with the terms of service.

Violations of the mentioned restrictions can lead to immediate deletion of the relevant content, blocking of your account, blocking of the IP address or device ID.

Privacy and Security

We take the protection of your personal data and your privacy very seriously. The app collects certain personal data, including your email address, username, friends you follow, your IP address, and your reviews and comments. This data is used to enable you to use the app and its features and to provide you with personalized book recommendations based on your reading taste and reviews.

We take extensive security measures to protect your data. Data transmission occurs via standardized HTTPS connections to ensure secure communication between your device and our servers. The collected data is stored encrypted on the highly secure servers of Microsoft Azure. Additionally, we rely on your chosen privacy settings and the password you set to protect access to your account and data.

Your personal data is only shared with third parties for fulfilling the functionalities of this app and when there is a legal obligation or your explicit consent. Specifically, we work with SendGrid, a software by Twilio Inc., which handles email delivery for us.

SendGrid is a trusted provider of email services that offers a robust platform for sending and receiving emails. The collaboration with SendGrid enables us to ensure optimal delivery of our email communication and guarantee that our messages reach you reliably and promptly.

It is important to note that in our collaboration with SendGrid, we carefully ensure that your personal data and information are protected. SendGrid operates in compliance with applicable data protection laws and has implemented strict security measures to protect your data from unauthorized access, loss, or misuse.

As part of our collaboration with SendGrid, some of your personal data, such as your email address or username, may be transmitted to and processed by SendGrid. This transmission and processing occurs solely for the purpose of delivering our email communication to you and ensuring that this information reaches you. We want to emphasize that SendGrid will never use your data for its own purposes or share it with third parties, unless legally required or necessary to comply with our legal obligations.

If you have questions or concerns regarding privacy or security in connection with SendGrid, please do not hesitate to contact us. We are committed to taking your concerns seriously and providing you with additional information to address your concerns. UHS Computer uses your data exclusively for operating the app, providing features, and personalizing book recommendations. However, your data is stored on Microsoft Azure servers. Microsoft does not have permission to access or analyze this data, unless legally required or necessary to comply with legal obligations.

We store your personal data only as long as necessary for the purposes for which it was collected. If you delete your account or no longer use the app, your data will be deleted according to our applicable policies and legal requirements. Your reviews will be retained even after your account deletion; however, they will be anonymized and no longer attributable to an account or person.

You have the right to view, modify, or delete your personal data. You can do this through the appropriate functions in the app or contact our data protection officer for further assistance.

Please note that the app or website may use cookies or similar tracking technologies to enable certain functions and analyze app usage.

Disclaimer and Warranty

1. User-generated content: The app allows users to share content such as book covers, reviews, and comments. We assume no liability for this user-generated content. Each user is solely responsible for the content they create and is liable for any legal violations, copyright infringements, or other damages that may result.
2. Accuracy, availability, and reliability: We strive to provide accurate and current information in the app. However, we cannot guarantee the accuracy, availability, or reliability of the information in the app. Use of the app is at your own risk.
3. Results and user experiences: The app offers users the opportunity to rate books, interact with others, and receive recommendations. We assume no responsibility for individual results or user experiences based on using the app. The experiences and results are based entirely on user-generated content and individual user preferences.
4. Limitation of liability: Under no circumstances are we liable for direct, indirect, incidental, special, or consequential damages, including lost profits or losses arising from the use or inability to use the app. This applies regardless of whether we have been advised of the possibility of such damages.
5. Own security measures: We recommend that users take appropriate security precautions and carefully protect their account information and personal data. We assume no responsibility for actions by other users, including unauthorized access to accounts or publication of personal information.

Changes to Terms of Service

We reserve the right to change or update these terms of service at any time at our discretion. We will inform users of changes via email linked to their account. The amended terms of service will automatically take effect unless the user objects within 14 days of receiving the notification.

It is the user's responsibility to regularly check their emails and take note of updates to the terms of service. Continued use of the app after the changes take effect constitutes automatic consent by the user to the updated terms of service.

Users who do not accept the new terms of service have the option to delete their account and discontinue use of the app. Further use of the app after the changes take effect means the updated terms of service are binding.

Please note that we are not authorized to make changes to the terms of service that restrict users' legally prescribed rights or include substantial changes to their rights and obligations without their consent.

Termination of Terms of Service

Use of the app and associated services may be terminated at any time. Both the user and UHS Computer have the right to terminate the terms of service and end the user account.

Users can close their account at any time by selecting the appropriate option in the app's account settings or contacting YourShelf support. Upon account termination, all personal data of the user will be deleted, however reviews will remain but will be anonymized. The content of reviews will not be changed. Uploaded book covers will continue to be displayed to other users, unless they must also be removed from the app due to the reason for deletion.

UHS Computer may terminate the terms of service at any time for important reasons, including violation of the terms of service, misuse, fraudulent behavior, or unlawful activities by the user. In such cases, the user's account may be blocked or deleted without prior notice.

After termination of the terms of service, regardless of whether by the user or by UHS Computer, the user's right to use the app and its services expires. The user is obligated not to continue using the app after termination of the terms of service.

Please note that upon termination of the terms of service, no refund of any payments or subscriptions made will occur, unless expressly stated otherwise.

Miscellaneous Provisions

Should any provision of these terms of service be or become wholly or partially invalid, void, or unenforceable, this shall not affect the validity and enforceability of the remaining provisions. The invalid, void, or unenforceable provision shall be replaced by a valid, effective, and enforceable provision that comes as close as possible to the economic purpose of the invalid provision.

These terms of service and the use of the app are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. To the extent legally permissible, the competent court at the seat of UHS Computer is agreed as the exclusive place of jurisdiction for all disputes in connection with these terms of service and the use of the app.
